Right of withdrawal for consumers
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (LAB46 GmbH, Torstrasse 105-107, 10119 Berlin, telephone: +49 (0)30 814 50 2390, email: support@lab46.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to MILLER & BECKER GmbH & Co. KG, Mielestr. 1, 48231 Warendorf, Germany, immediately and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. We will bear the costs of returning the goods. You will only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.
Cancellation and reshipment fees
Free cancellation of the order is possible provided that the goods have not yet been shipped at the time of cancellation and the supplier has not incurred any costs as a result.
If the item has already been shipped, a processing and return fee of €8.00 will apply in the event of a cancellation. This fee covers the costs of return shipping, storage, and the inspection and reconditioning of the returned merchandise.
If you do not receive the merchandise and request that it be reshipped, a processing fee of €8.00 will also be charged. This fee covers the costs of reshipping, returning, and storing the original shipment.
A restocking fee of €8.00 will be charged if:
- the goods could not be delivered due to an incorrect delivery address provided by the customer,
- the goods could not be deposited at the selected drop-off point (pick-up point, Packstation, etc.) due to an incorrect or unstated identification number (e.g., postal number for DHL Packstations in Germany),
- the goods were returned to the sender because they were not collected from the relevant branch or collection point within the collection period set by the shipping service provider,
- delivery has failed due to incomplete or illegible address information provided by the customer,
- the customer or an authorized recipient refused to accept the goods,
- delivery was not possible despite multiple delivery attempts by the shipping service provider because the recipient was repeatedly not at home and no alternative delivery option (e.g., parking permit, neighbor) was provided,

delivery could not be made for other reasons beyond LAB46's control and for which the customer is responsible.
The aforementioned fees will be offset against the refund amount from the revocation or, if no refund is made, invoiced separately.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts:
- for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
