Right of withdrawal for consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period is 14 days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods.

To exercise your right of withdrawal, you must notify us (LAB46 GmbH, Torstraße 105–107, 10119 Berlin, phone: +49 (0)30 814 50 2390, email: support@lab46.de) by means of a clear statement (e.g., a letter sent by mail or an email) regarding your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, though its use is not mandatory.

You can also submit your cancellation directly through our cancellation feature at www.lab46.de/pages/widerrufsformular. If you use this feature, we will immediately confirm receipt of your cancellation via email.

To comply with the cancellation period, it is sufficient to send the notice of your intention to exercise your right of cancellation before the cancellation period expires.

Consequences of revocation

If you cancel this contract, we must refund to you all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without undue delay and no later than 14 days from the day on which we receive notice of your withdrawal from this contract. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or deliver the goods to the following address without delay and, in any case, no later than 14 days from the date on which you notify us of your withdrawal from this contract:

The deadline is met if you ship the goods before the 14-day period expires.

You are responsible for the direct costs of returning the goods, which amount to a flat fee of €8.00. This flat-rate return fee will be deducted from the refund amount or, if no refund is issued, billed separately.

You are only liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functionality.

Cancellation and Reshipment

You can cancel your order free of charge, provided the items have not yet been shipped at the time of cancellation.

A reshipment fee of €8.00 will be charged if delivery fails for reasons attributable to you, in particular if:

• the goods could not be delivered because you provided an incorrect shipping address,

• the goods could not be deposited at the selected drop-off location (pickup point, Packstation, etc.) due to an incorrect or missing identification number (e.g., postal number for DHL Packstations),

• the merchandise was returned to the sender because it was not picked up from the store or pickup location within the pickup period set by the shipping provider,

• delivery failed due to an incomplete or illegible address,

• You or an authorized recipient refused to accept the goods.

This fee covers the costs of returning and reshipping the package. It will be deducted from any refund or billed separately.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been broken after delivery.
